LAF ONLINE STORE TERMS AND CONDITIONS

This document (the "Agreement") is a legal contract between you and LAF Productions, Inc. ("LAF Productions") that governs your use of "LAF Online Store" available at www.LAFproductions.com (together the "Service"). The terms below will apply to you if you use the "LAF Online Store" download sales service (that is free to access).

Notice

LAF Productions may from time to time modify these terms and post a copy of the amended Agreement on its website, www.LAFproductions.com.  If you do not agree to (or cannot comply with) the Agreement as amended, your only remedy is to stop using the Service. You will be deemed to have accepted the Agreement as amended if you continue to use the Service after any amendments are posted.

Age Requirement

You must be at least 18 years of age to agree to and enter into this Agreement on your own behalf and for use of the Service.  If you are under 18 years of age, you must present this Agreement to your parent or legal guardian, and he or she must enter into this Agreement on your behalf with making any and all purchases.  Making a purchase from the LAF Online Store indicates your acceptance to this Agreement, which you represent that (i) you have read, understood and agree to be bound by this Agreement and (ii) you are at least 18 years old, either entering into this Agreement for yourself or entering on behalf of your child or a child in your legal care. If you are a parent or guardian entering this Agreement for the benefit of your child, please be aware that you are fully responsible for his or her use of the Service, including all financial charges and legal liability that he or she may incur.  If you do not agree to (or cannot comply with) any of these terms and conditions, neither attempt to access the Service nor make a purchase.

Description of Service

The Service (that is free to access) allows you to listen to Samples (as defined below) and obtain downloads of sound recordings of a book being read to you ("Audiobooks"), electronic books for screen viewing ("e-Books"), sound recordings ("Tracks") and related digital content ("Materials").  You are responsible for any hardware, systems and/or software program(s) you use and any associated fees and expenses (a) to connect to or use the Internet, and/or (b) other than the Client, to use any Materials. The Service, the Tracks and/or the Materials (including any LAF Productions promotional offers or codes redeemable for the Audiobooks, the e-Books, Service, the Tracks and/or the Materials) are only for your personal, non-commercial use and are non-transferable (except as otherwise expressly authorized by LAF Productions).

USE OF AUDIOBOOKS, E-BOOKS, TRACKS AND MATERIALS

Audiobooks, e-Books, Tracks and Materials

LAF Productions owns the Audiobooks, e-Books, Tracks and Materials, as applicable, and they are protected by intellectual property laws.  You agree that the content rights holders that license their musical or other content to LAF Productions for sale in the LAF Online Store are intended third-party beneficiaries under this Agreement with the right to enforce the provisions that directly concern their content.  You understand that your use of Audiobooks, e-Books, Tracks and Materials is subject to the Usage Rules discussed below.  You may not authorize, encourage or allow any Audiobooks, e-Books, Tracks or Materials used or obtained by you to be reproduced, modified, displayed, performed, transferred, distributed or otherwise used by anyone else.  You agree to inform LAF Productions quickly of any such unauthorized use(s).

Usage Rules.

Your access to and/or use of any Audiobook(s), e-Book(s) and Track(s) will be limited by the rules assigned to the Audiobook(s), e-Book(s) and Track(s) by LAF Productions ("Usage Rules") and described in this section. You may not attempt (or support others' attempts) to circumvent, reverse engineer, decrypt, or otherwise alter or interfere with any Usage Rules or Audiobooks, e-Books or Tracks.  LAF Productions reserves the rights to modify the Usage Rules at any time.

A "Sample" is a portion of an Audiobook, e-Book, Track or, in some cases, an entire Track or promotional music video that you can play (and, if applicable, view) directly from and while you are logged on to LAF Productions’ website on a promotional basis at no cost to you.  You may play as many Samples as you like.  You may not attempt (or support others' attempts) to capture, copy, or download a Sample.

A "Purchased Audiobook" is an Audiobook that you may (1) save to the hard drives of up to three (3) of your personal computers and play back at any time, (2) burn to a CD and/or (3) transfer to a compatible portable device.  Any security technology that is provided with a Purchased Audiobook is an inseparable part of it.  If you have Purchased Audiobooks, it is your responsibility not to lose, destroy or damage them.  LAF Productions shall have no liability to you in the event of any such loss, destruction, or damage.

A "Purchased e-Book" is an e-Book that you may (1) save to the hard drives of up to three (3) of your personal computers and play back at any time, (2) burn to a CD, (3) print, if applicable, and/or (4) transfer to a compatible portable device.  Any security technology that is provided with a Purchased e-Book is an inseparable part of it.  If you have Purchased eBooks, it is your responsibility not to lose, destroy or damage them.  LAF Productions shall have no liability to you in the event of any such loss, destruction, or damage.

A "Purchased Track" is a Track that you may (1) save to the hard drives of up to three (3) of your personal computers and play back at any time, (2) burn to a CD and/or (3) transfer to a compatible portable device.  Any security technology that is provided with a Purchased Track is an inseparable part of it.  If you have Purchased Tracks, it is your responsibility not to lose, destroy or damage them.  LAF Productions shall have no liability to you in the event of any such loss, destruction, or damage.  You may purchase Tracks on an individual basis and you may also be offered the ability to purchase Tracks in groups of 3 "three" (called "Trinity Track Packs"), at discounted pricing.

If you have received a valid promotional code or gift certificate for LAF Productions, you should follow the instructions that you received with such promotion to redeem that code or gift.  If you properly input a valid promotional offer, it will be reflected in your sale transaction account.  LAF Productions promotional offers and gift are certificates subject to any expiration dates that may be so noted with the offer and are not redeemable for cash (and any unused portion may not be returned for cash or any other value).

You may burn each Purchased Track to a CD an unlimited number of times, but may only burn each Purchased Track up to seven (7) times as part of any particular playlist of songs.  A "playlist" is a discrete group of Purchased Tracks that are arranged together in a particular order.  Once you have burned a Purchased Track to a CD, you agree not to copy, distribute, or transfer the track from that CD to any other media or device.  You may transfer a Purchased Track an unlimited number of times to three (3) portable devices that are compatible with LAF Productions’ Usage Rules and security requirements.  Once you have transferred a Purchased Track to a compatible portable device, you agree not to copy, distribute, or transfer it from that device to any other media or device.

The burning or transfer capabilities provided for herein shall not operate to waive or limit any rights of the copyright owners in Tracks or Materials or any works embodied in them.

Electronic Contracts

You agree that any submissions you make for electronic purchases constitute your intent and agreement to be bound by the terms of and to pay for such purchases. To the extent that such electronic purchases are offered to you by a third party, you acknowledge that LAF Productions shall not be responsible or liable to you for the products or services purchased.

COPYRIGHT INFORMATION

Audiobooks

As noted above, the Audiobooks and the Materials contain and/or comprise copyrighted or other proprietary subject matter, and your use of them is governed by this Agreement, certain end-user license agreements, and applicable law.

e-Booklets, e-Books and e-Journals

Fiction (non-printing)

This is a work of fiction.  Names, characters, places, and incidents are products of the author’s imagination or are used fictitiously and are not to be construed as real.  Any resemblance to actual events, locales, organizations, or persons, living or dead, is entirely coincidental.

LAF Productions reveres the intellectual property rights of others, and expects you to do the same.  If you know of or suspect that any use of the Tracks, Materials and/or LAF Productions constitutes copyright infringement, please send a notice by email (Publisher@LAFproductions.com) or by fax to 866-213-4437.  The notice must contain all of the information set forth in Section 512(c)(3)(A) of the U.S. Copyright Act, 17 U.S.C. § 101 et seq.

PATENT AND TRADEMARK

All trademarks, service marks, trade names, slogans, logos, and other indicia of origin that appear on are the property of LAF Productions and/or its affiliates, licensors and/or licensees.  You may not copy, display or use any of these marks without prior written permission of the mark owner.

ELECTRONIC AND NON-ELECTRONIC RETURN POLICY

At LAF Productions, we perform due diligence to minimize risk of our customers by carrying only high-quality products and dealing with professional and reliable distributors/wholesalers. Every product comes with our 100% satisfaction guarantee. If you are not happy after initial inspection with quality, materials, or workmanship, please fill out a LAF Productions Return Merchandise Authorization (RMA) request to have your order returned, only returnable up to 30 days from the order date. A 15% restocking fee will be charged for all non-defective returns. For undeliverable and refused orders, the restock is 10%.

Returns to Manufacturer ONLY:

The following vendors must be contacted directly for credit/replacement of defective merchandise. In accordance with Manufacturer Policy, we will not accept items made by these vendors for return and will not issue credit. However, we will do our utmost to assist you in getting proper resolution from these manufacturers.

CHAUVET products are not returnable for any reason (per the manufacturer).

OPTOMA products are non-returnable for any reason (per the manufacturer).

JVC products:  Contact the manufacturer @ 800-537-5722.

PANASONIC products:  Contact the manufacturer @ 800-222-4213.

PHILIPS products:  read below:

PHILIPS End-User Return Policy:  Philips DVD, DVD/VCR combo and VCR units have a 90-day OTC exchange warranty for defective units. After 90 days through 1 year, an exchange can be made through Philips for a nominal fee.

SAMSUNG products:  Samsung will only accept product returns due to the inability of Samsung to service the product on a timely basis. You must call Samsung for all returns at 1-800-SAM-SUNG.

SONY products are non-returnable for any reason (per the manufacturer).

Note: If you have a defective product, you may contact Sony directly. All new items have a 1 year manufacturer warranty and refurbished products have a 90 day manufacturer warranty. You have access to Tier 2 Tech Support through VAIO, 888-476-6938. If any issues, please notify us and we might be able to get the original receipts and information to Sony if needed.

TOSHIBA products: No returns for credit for TV, LCD TV, Plasma, DVD, portable DVD, VCR, DVD Recorders, Home Theater in a box, TV/VCR or TV/DVD.  Authorized customer service center for repair only. (800-631-3811)

TOSHIBA PROJECTORS: Call Toshiba 877-523-8324.

COBY ELECTRONICS products are non-returnable for any reason (per the manufacturer).

ASUS products: The supplier cannot accept Asus products back.  You must contact the manufacturer at 888-678-3688.

ACER products: Supplier can only accept defective products for this manufacturer.  You may need to call the manufacturer directly depending on the situation.

ELITESCREENS products: Unfortunately, supplier cannot accept returns for this brand. Please contact manufacturer directly.

HIDEKI ELECTRONICS:  Must contact the manufacturer (30 day warranty).

HAIER AMERICA TRADING products: You must contact the manufacturer directly at 877-337-3639.

HONEYWELL products: You must contact Honeywell directly.

LENOVO products: All Defects call Lenovo 877-536-9955 x2. Supplier does not accept these items back.

EMERSON products: All Defects - Call Vendor 800-898-9020.

EPSON products: Must contact Epson directly, 562-276-4382.

AMERICAN POWER CONVERSION products: Supplier does not accept returns.  You must contact the manufacturer at 800-890-4272 or 800-800-4272.

CASIO products: Supplier does not accept returns. You must contact the manufacturer.

TARGUS products: Call Targus 877-482-7487.

YAMAHA products:  All Defects - Call Yamaha 800-492-6242.

CANON – printers: Call Canon 800-423-2366.

EPSON – printers: Call Epson 800-922-8911.

FELLOWES – shredders: Call Fellowes 800-955-0959.

LIVAMA – ALL PRODUCTS:  Call Livama 800-394-4335.

Products with manufacturers’ warranties: Any product that has a manufacturer's warranty needs to go through them directly.

Damaged Goods:

Interior Damage Only:  If the exterior package/carton is intact and only the interior product is damaged, contact our Customer Service Department for an RA number.

Exterior Carton Damage by Carrier:  If the exterior package/carton is damaged, causing damage to the contents, you MUST keep the original package/carton and then call Customer Service for a claim to be filed.  If the original damaged package/carton is not available, there will be NO chance for a credit to be issued to you.  See specific Carrier Policies below:

FEDEX – Damaged in Transit, Non-Delivery or Denial of Signature Claims

Claims for FedEx shipments damaged in transit, non-delivery or denial of signature must be made within 15 days of original invoice.

UPS – Damaged in Transit Claims

Claims for UPS shipments damaged in transit must be made within 30 days of date of original invoice AND, original shipping carton must be retained.
